By making a reservation at the Cherrywood Estate you will have to accept the following Waiver of Liability. This includes all guest traveling with you or guest invited by you on property. Swimming Pool Waiver and Release of Liability Form Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement PLEASE READ CAREFULLY. BY MAKING THIS RESERVATION YOU ACCEPT THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. To: The Cherrywood Estate / Hans Robert Heim & Hanne Pardos Limbeck (Owner of Property, Releasees) I wish to swim at the House’s pool during the length of stay at your vacation home. By swimming in the vacation home pool, I recognize and fully understand certain things, including: o At no time is there a lifeguard on duty, you (the renter) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay. o My use of the pool facilities during my stay involves certain risks, including but not limited to: 1. The risk of injury resulting from possible malfunction of the pool equipment; 2. The risk of injuries resulting from tripping or falling over obstacles in the pool area; 3. The risk of injuries resulting from unsupervised divers and swimmers colliding; 4. The risk of other injuries resulting from participating in any action in the pool. I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. In exchange for the Owner allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below: o TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area; o TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES; o TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area; o That I am over the age of 18 and that I am responsible and will adhere to all the rules of the property; o That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, my guests traveling with me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. I have read and understood this document. I am aware that by making this reservation I accept this document, I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so. Here is additional info on your rental. • Please call on the day of arrival for the code to the electronic door lock. • We use the door to the left under the carport as the main entry for in / out. • Make sure to keep all other doors/windows locked at all times • Check-in is after 4 pm and check-out is before 11 am. As a Host, we aim to make your stay as comfortable as it can possibly be! Our mission is to help our guests create beautiful family memories in our home. For us to do so, we would appreciate it if you will follow our house rules. We have listed some important ones of them here as well as in the attached rental agreement with the house rule addendum. Please let us know immediately if something is malfunctioning, in need of cleaning, or damaged so it can be rectified. However, all damages or missing items discovered after your stay will need to be paid for by you and will be charged against your deposit. Thank you in advance and we truly appreciate your cooperation! - Pls, no shoes inside the house. - There are absolutely no open fires or cooking on the porch or patio and on or around the wooden steps and deck. - There shall not be any smoking, vaping or use of marijuana inside the home. An extra cleaning fee of $500 to remove odor and stains will be applied. - PLEASE clean up the kitchen/refrigerator and wash your dishes and put them back up after use. If dishes are not washed and properly stored, an additional cleaning fee of $50 will be applied. - All trash must be securely bagged and placed in the outside trash bin for pick up Thursdays. - PLEASE NOTE: Children friendly DOES NOT MEAN the area is CHILD-PROOF. It is the responsibility of the parent/guardian to monitor their children's actions AT ALL TIMES. - Please remove any food you bring with you prior to departure. Some food items are in the cupboards and refrigerator (sugar, coffee, etc.) which you are welcome to use, we ask that you replace whatever you empty before your departure. - Please acknowledge that occasionally, we may leave non-perishable consumables such as condiments or snacks left behind by previous guests if they are not empty. We try our very best to ensure that it is not expired or stale. However, ultimately, it is up to the guests' discretion and inspection to consume these items if they wish. The host does not take any responsibility for the consumables. - Please do not rearrange our furniture. - We do not allow visitors, parties, or gatherings of any kind on premises at any time. Maximum occupancy is 6 guests. - If guests are found to have had additional people on the property, guests will be responsible for the additional charge of $200 per person over the maximum occupancy of 6 and any extra cleaning charges - Please bring your own supply of coolers and iceboxes if you are planning to keep larger amounts of Beverages and Supplies cool during your stay. Even so, the house is equipped with a regular-sized fridge, overloading it with large amounts of beverages, etc. will make it run so hard that it will freeze up and eventually stop working. - Lastly, because this is part of the VRBO/Airbnb community and not a hotel and is also our home when we stay in town, please be respectful of the property and keep it clean before you leave.
